First Addendum

 

FIRST ADDENDUM TO DECLARATION OF

RIGHTS, RESTRICTIONS, AFFIRMATIVE OBLIGATIONS

AND CONDITIONS APPLICABLE TO ALL PROPERTY IN WOODLAKE

 

     THIS FIRST ADDENDUM TO Declaration of Rights, Restrictions, Affirmative Obligations and Conditions Applicable to all Property in Woodlake (the "Declaration") made this 1st day of September, 1995.

RECITALS

     1. On September 14, 1983 Investors Woodlake Development Corporation, a Virginia corporation, hereinafter called "Company" filed for record the Declaration, which is recorded in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, in Deed Book 1625, page 463.

     2. By Assignment and Waiver Agreement dated October 25, 1993, recorded in the aforesaid Clerk's Office prior to the recordation of this Addendum, WLAC, Incorporated, successor to the Company, assigned all rights of the Company under the Declaration to Woodlake Community Association, Inc. (the "Association").

     3. Due to the desire of the Association to make certain amendments to the Declaration as provided in Part VI, Section 2 of the Declaration, the amendments were presented to a duly called meeting of the Owners of Properties held on April 25, 1995 at Woolridge Elementary School in Chesterfield County, Virginia, pursuant to notice to all Owners of Properties on March 27, 1995, and in accordance with the pertinent provisions of the Declaration. A quorum of sixty percent (60%) not being present for such meeting, a subsequent meeting of the Association was called pursuant to the aforesaid section of the Declaration at which the amendments were presented. This duly called meeting of the Owners of Properties was held on July 25, 1995, at the Woodlake Community Association Building, Chesterfield County, Virginia, pursuant to notice given on June 23, 1995, to all Owners of Properties, and in accordance with the pertinent provisions of the Declaration. As of the date of the meeting, the total number of votes of all Owners of Properties substantially affected by the amendments (being all Owners of Properties in Woodlake) was 5,508; the total number of votes required to constitute a quorum was 1653; a quorum comprised of 2585 was present in person or by ballot for the amendments contained herein, the number of votes necessary to adopt each proposed amendment, and the number of votes for or against each proposed amendment were as follows:

AMENDMENTS

NOW THEREFORE, the Declaration is amended as follows so that from the effective dates hereof, the real property described therein shall be held, transferred, sold, conveyed, given, donated, leased, occupied and used subject to the following:

A. Part V, paragraph 11, subparagraph (b) of the Declaration is amended to read as follows:

Satellite dishes not exceeding eighteen (18") inches in diameter may be installed following written approval by the Association in accordance with standards and guidelines established by it.

B.
Part V, paragraph 8 is amended by adding subparagraph (c) to read as follows:

Notwithstanding anything in this Declaration to the contrary, the Association expressly reserves unto itself, its successors and assigns, the right to regulate the collection of disposable materials, including, but not limited to leaves and recyclables, within Woodlake and to establish rules and regulations related to available or mandated collection service to property owners.

C. Capitalized terms defined in the Declarations shall have the same meanings when used in these Amendments.
D. These amendments shall become effective September 24, 1995, sixty (60) days after the date of the meeting of the Owners of Properties at which they were adopted.
IN WITNESS WHEREOF, the President and Secretary of the Association have executed this Addendum pursuant to Part VI, Section 2 of the Declaration.
